Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy. 
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

In no case shall Ascend Forex, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Ascend Forex and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United States.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - MANAGED ACCOUNT SERVICES

Ascend Forex Managed Account Service
VIA Ultima Markets 

1. Acceptance of Terms

By enrolling in the Ascend Forex Managed Account Service (the "Service"),

You ("PAMM Investor") agree to:

  • These Terms and Conditions;
  • Ascend Forex’s standard Terms and Conditions, Privacy Policy, Risk Disclosure and all other Policies.
  • Ultima Markets’ standard Terms and Conditions, Privacy Policy, Risk Disclosure PAMM Service Agreement, its Supplemental Agreement (collectively, the "PAMM Agreements"), and all other Policies;

 

Refusal to accept these terms prohibits Service use.

2. Service Description

2.1 Managed PAMM Account

  • Ascend Forex provides discretionary Forex/CFD management via Ultima Markets’ PAMM accounts.
  • PAMM Investors must:
    • Open/maintain a PAMM account with Ultima Markets;
    • Link it to Ascend Forex’s PAMM management system.
  • Trading authority is granted to Ascend Forex’s traders, but PAMM Investors retain fund ownership.

2.2 Supplemental PAMM Terms

  • The Supplemental Agreement to the PAMM Service Agreement (August 2025) governs fee enforcement and investor removal. Key terms:
    • Agreed Fees: Management/performance fees payable directly to Ascend Forex (not via Ultima Markets).
    • Non-Payment: Ascend Forex will request Ultima Markets to remove the PAMM Investors from PAMM accounts after 24 hours of late payment.
    • No Broker Liability: Ultima Markets is not responsible for fee disputes or removal consequences.

3. PAMM Investor Eligibility

  • Age/Legality: 18+ and compliant with local Forex regulations.
  • KYC: Complete verification with both Ascend Forex and Ultima Markets.
  • PAMM Compliance: PAMM Investors must adhere to both Ascend Forex and Ultima Markets’ terms and Conditions.

4. Fees & Profit Sharing

4.1 Fee Structure

  • Management Fee: $ 199 billed monthly or $99 billed weekly by Ascend Forex.
  • Performance Fee: 50% of net profits (charged daily) by Ascend Forex.

4.2 Payment Terms

  • Fees are non-refundable and billed separately from Ultima Markets’ platform fees.
  • Non-Payment: Triggers suspension/termination per Section 7.

5. Risk Disclosure

  • Market Risks: Forex/CFDs may lead to total capital loss.
  • No Guarantees: Past performance ≠ future results.
  • Broker Risks: Ultima Markets’ platform issues (e.g., slippage, downtime) may affect trades.

6. Account Funding & Withdrawals

  • Minimum Deposit: $ 1000.
  • Withdrawals: Processed in 1 day (subject to Ultima Markets’ procedures).
  • Balance Requirements: Falling below minimums may suspend Service.

7. Termination

7.1 Voluntary Termination

  • Either party may terminate with 1 days’ written notice.

7.2 Non-Payment Termination

  • Missed Fees: Ascend Forex may:
    • Suspend trading after 1 day overdue;
    • Terminate Service and request Ultima Markets remove the PAMM Investor from the PAMM system.
  • Reinstatement: Requires full payment of arrears + late fees.

7.3 Post-Termination

  • PAMM accounts will be unlinked from Ascend Forex;
  • Open positions may not be closed automatically.

8. Liability & Indemnification

  • Ascend Forex and Ultima Markets are Not Liable For:
    • Market losses, broker/platform failures, or force majeure events.
    • Ascend Forex’s’ actions (e.g., PAMM removals, fee disputes).
    • Ultima Markets’ actions (e.g., PAMM removals, fee disputes).
  • PAMM Investor Indemnification: Covers unauthorized account use or policy breaches.

 9. Partnership with Ultima Markets

  • Ascend Forex is a third-party manager; Ultima Markets is solely the broker.
  • PAMM Investors must separately agree to Ultima Markets’ terms.

10. Dispute Resolution

  • Negotiation → Arbitration in Saint Vincent and Grenadines.
  • Governing Law: Saint Vincent and Grenadines.

11. Supplemental PAMM Agreement

This Service operates under:

  1. Ultima Markets’ PAMM Service Agreement;
  2. Supplemental Agreement (August 2025), which permits:
    • Fee enforcement via PAMM removal;
    • No broker involvement in fee disputes.

By enrolling, PAMM Investors acknowledge all above agreements.


SECTION 21 - ASCEND FOREX AI SMART CHARTS

These Terms of Service ("Terms") govern your access to and use of the Ascend Forex AI Smart Charts web application ("the App"), operated by Ascend Forex ("we," "us," "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. DESCRIPTION OF SERVICE

Ascend Forex AI Smart Charts is an AI-powered analytical tool that provides chart scanning, market insights, trading signals, economic news alerts, and an AI assistant ("Ask AI") for forex, crypto, metals, energies, indices, and CFD markets. The App is an analytical tool only and does not execute trades on your behalf.

2. ELIGIBILITY

You must be at least 18 years of age to use the App. By registering, you confirm that you are of legal age in your jurisdiction and that the use of such analytical tools is permitted under your local laws.

3. ACCOUNT REGISTRATION

  • You must provide a valid email address and verify it before accessing paid features.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not create multiple accounts to circumvent subscription limits or abuse the service.
  • We reserve the right to terminate accounts that violate these Terms without refund.

4. SUBSCRIPTION PLANS AND BILLING

  • Free Tier: Provides access to the App with zero (0) daily scans. No payment required.
  • $1 Trial (3 Days): Provides 3 daily scans for 3 days. Automatically upgrades to the Weekly Pro plan ($49/week) on Day 4 unless canceled before that date.
  • Weekly Pro ($49/week): Provides 10 daily scans with access to all asset classes and 6 timeframes. Renews automatically every 7 days.
  • Monthly Elite ($149/month): Provides 12 daily scans with full access to all pairs, timeframes, and VIP support. Renews automatically every 30 days.
  • Credit Packs (Top-Ups): One-time scan credit purchases ranging from 5 to 50 scans. Non-refundable once purchased.

All subscriptions auto-renew at the end of each billing cycle. Prices are in USD and are subject to change with reasonable notice.

5. PAYMENT AND PROCESSING

  • All payments are processed securely through Stripe. We do not store your card details on our servers.
  • By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
  • If a recurring payment fails, your account will be downgraded to the Free tier (0 scans) and we will attempt to collect payment for up to 10 days. If all attempts fail, your subscription will remain inactive until you re-subscribe.

6. CANCELLATION AND REFUNDS

  • You may cancel your subscription at any time from the Client Portal under "My Subscriptions."
  • Upon cancellation, you retain access to your current plan until the end of the paid billing period.
  • The $1 Trial auto-upgrades to Weekly Pro on Day 4. To avoid the $49 charge, you must cancel before the end of Day 3.
  • Refund requests are handled on a case-by-case basis. To request a refund, contact us at hello@ascendforex.com. Approved refunds will be processed to the original payment method within 5-10 business days.
  • Credit Pack purchases are non-refundable.
  • Any used tiers are non-refundable. 

7. NOT FINANCIAL ADVICE

  • The App provides AI-generated analytical insights and signals for educational and informational purposes only.
  • Nothing in the App constitutes financial, investment, tax, or legal advice.
  • You are solely responsible for your trading decisions, risk management, and capital allocation.
  • We do not guarantee profits, returns, or any specific trading outcomes. Past performance is not indicative of future results.
  • Forex, crypto, and CFD trading involve substantial risk of loss and are not suitable for all investors. Never trade with money you cannot afford to lose.

8. AI-GENERATED CONTENT

  • The App uses artificial intelligence (including DeepSeek and other AI models) to generate chart analysis, trade signals, and conversational responses via Ask AI.
  • AI outputs are probabilistic and may contain errors, inaccuracies, or outdated information.
  • You should independently verify any AI-generated analysis before acting on it.
  • We do not guarantee the accuracy, completeness, or timeliness of any AI output.

9. ACCEPTABLE USE

You agree not to:

  • Use the App for any unlawful purpose.
  • Reverse-engineer, scrape, or attempt to extract the source code or algorithms of the App.
  • Share, resell, or redistribute your account access or any content from the App.
  • Use automated bots, scripts, or tools to interact with the App.
  • Attempt to bypass subscription limits, scan restrictions, or payment requirements.
  • Create multiple accounts to exploit free or trial offerings.

10. INTELLECTUAL PROPERTY

All content, design, code, AI models, algorithms, branding, and materials within the App are the property of Ascend Forex and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. DATA AND PRIVACY

  • We collect and process personal data in accordance with our Privacy Policy (available at https://ascendforex.com/policies/privacy-policy).
  • By using the App, you consent to receiving transactional emails, SMS messages, and WhatsApp communications related to your account, subscription, and service updates.
  • You may update your communication preferences in your account settings.

12. SERVICE AVAILABILITY

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted access.
  • The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
  • Market data, charts, and signals depend on third-party data providers, and we are not liable for delays or inaccuracies in their feeds.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Ascend Forex shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App or reliance on its outputs.
  • This includes, but is not limited to, trading losses, lost profits, data loss, or business interruption.
  • Our total liability shall not exceed the amount you paid for the App in the 30 days preceding the claim.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Ascend Forex, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the App, your trading activities, or your violation of these Terms.

15. MODIFICATIONS TO TERMS

We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

16. TERMINATION

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in abusive behavior, or for any other reason we deem appropriate. Upon termination, your access will be revoked and no refund will be issued for the remaining billing period.

17. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ascend Forex is registered, without regard to conflict of law principles.
